SKIN TONE MASTER PROFILES SINGLE END-USER LICENSE AGREEMENT


Notice to User. Please read the following Single End-User License Agreement (hereinafter the "Agreement") carefully before using Skin Tone Master Profiles (hereinafter the "Software"). This is a legal Agreement between you, the End-User, and the Author of Skin Tone Master Profiles (hereinafter the "Author") covering your use of the Software. By installing and/or using this Software, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree with these terms and conditions, do not install and/or use this Software.

Grant of License. The Author grants you a non-exclusive license to use the Software included herein subject to the terms and conditions of this Agreement. For the purposes herein, "Skin Tone Master Profiles" shall constitute all component parts that are distributed herein including all program files, data files, support files and documentation provided. The Software is licensed as a single product. Its component parts may not be separated or distributed. The Software is solely for your own personal use, on one computer at one time. You may use this Software on a different computer, but it may not be used on two or more computers at the same time. You may make a working copy of the Software and a backup copy for archival purposes only.

Ownership. Skin Tone Master Profiles was created and is owned by the Author. The Author shall retain all ownership rights in the Software. The Software is protected by Copyright Laws and International Treaty provisions. Any use of the Software in violation of these laws shall constitute a termination of this Agreement. Therefore, you must treat the Software like any other copyrighted material. 

Termination. This license is effective until terminated. You may terminate it at any time by destroying the Software together with all copies and modifications in any form. This License also terminates if you fail to comply with the terms and conditions of this Agreement. 

Distribution. You may not distribute, publish, sell, transfer, rent, lease, sub-license or otherwise make available to others the Software or documentation or copies thereof. You may not distribute or publish the Installation/Registration Key or Password provided to you. You may not distribute the Software and/or related files by incorporating into or bundling with or as part of any application software product. 

Restrictions. You may not alter or remove any proprietary notices, labels, trademarks on the Software or documentation. You may not modify, translate, de-compile, disassemble or reverse engineer the Software. You may not create derivative works from the Software.

Disclaimer. The Software is provided on an "as-is" basis and without warranty of any kind, express, implied or otherwise, including without limitation, any warranty of merchantability or fitness for a particular purpose. Should the Software prove defective, you and not the author or its contributors assume the entire cost of any service and repair. The Author does not warrant that operation of the Software will be error-free or uninterrupted, or that any non-conformity, defect or error can or will be corrected.

Limitation of Liability. In no event shall anyone who has any part in the development of this software be liable for any direct, indirect, incidental, special, exemplary, or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data, opportunity or profits; or business interruption. Whether or not advised of the possibility of such damage, and on any theory of liability, arising out of or in connection with the use, inability to use or performance of the Software. 

The entire risk arising out of the use or performance of the Software remains with you. Use it at your own risk!
